Michael Jackson Trial Will Proceed As Planned; Jury Selection Begins Next Month

Michael Jackson's trial for charges of child molestation will continue as planned, despite the defense's best efforts to postpone the proceedings.

On Monday, the judge in the Jackson case denied the defense's motions to dismiss all charges
against their client or to delay his trial, according to Reuters.

During the first in a three-day series of pretrial hearings leading up to Jackson's January 31 trial (see "Jackson's Lawyers Seek Trial Delay, Grouse About Prosecutors' 'Sandbagging' "), the singer's lawyers argued that all charges against Jackson should be thrown out due to what they called "outrageous government conduct" by prosecuting attorney Tom Sneddon, whom they claim is seeking personal revenge against their client for his involvement in a prior molestation case, settled out of court in 1993 (see "Michael Jackson's Legal Team Wants DA Off Case, Alleging He Seeks Revenge").

They further requested — in a separate motion — that the trial be postponed to allow the defense ample time to wade through what they are now claiming is almost 22,000 pages of evidence submitted by the prosecution in the last two months.

Santa Maria Superior Court Judge Rodney Melville reportedly denied the defense's motions, citing a potential influx of new evidence and search warrants as a reason for not delaying the trial. "If I continue this case for three months," he said, "we'll have 90 more search warrants and 90 more motions."

Instead, the court will begin the first stages of jury selection next month.

In making his case to have the charges against Jackson dismissed, attorney Thomas Mesereau highlighted what he deemed to be questionable conduct by Sneddon.

"There has never been a child-molestation case in this country pursued at this level," he said. "There has never been a murder case in this country pursued at this level. This is being done because Mr. Sneddon wants glory and doesn't like Michael Jackson."

Jackson was reportedly not in court during Monday's hearings and is not required to attend until jury selection begins.

DMX Arrested For Driving Violations — Again

DMX, who pleaded guilty last week to driving under the influence and reckless endangerment, was arrested Wednesday for charges including speeding, driving an unregistered vehicle and third-degree aggravated unlicensed operation. The rapper,

whose real name is Earl Simmons, was driving 104 mph in a 65 mph zone on Interstate 684 in North Castle, New York, according to The Associated Press. His license had been suspended following a June incident at a New York's Kennedy International Airport (see "DMX Faces Drug, Weapons Charges After Airport Incident" and "DMX Pleads Guilty To DUI And Reckless Endangerment"). Following his arrest on Wednesday, Simmons, 33, was released on $350 bail and was ordered to appear in court on January 18. Prosecutors are investigating whether Wednesday's incident violated the terms of Simmons' conditional discharge, according to the AP. Simmons's lawyer and manager could not be reached for comment.

    Whitney Houston Hits Bus

Whitney Houston hit a city bus with her sports car near her home in Alpharetta, Georgia, on Wednesday and walked away unscathed.

The singer's Porsche, however, wasn't as lucky. The accident, which occurred around 5 p.m. as Houston was pulling out of a shopping center, left the bus with no noticeable nicks, but damaged the bumper of her car, according to Alpharetta Police Department Officer Tom Patton

As Houston was backing out of the shopping center's parking lot, a city bus was traveling down North Point Parkway, slowing down as it approached a bus stop. Houston misjudged the clearance between her car and the bus and clipped the bus' right fender with the right corner of her bumper.

Houston, who lives with husband Bobby Brown near the site of the accident, was cited for failure to yield while entering a roadway, a low-level moving violation in Georgia.
